Case Comment on Resorts World at Sentosa Pte Ltd v Lee Fook Kheun [2018] SGHC 173

Our firm’s N Sreenivasan, S.C., Shankar A S and Lim Min acted for Resorts World at Sentosa (“RWS”) in a claim against one of its casino patrons, Lee Fook Kheun. Lee Fook Kheun had sought and received a S$10 million credit line which he had utilised in full. He also made partial payments amounting to over S$4 million over a period of five years. However, when he stopped making payment, RWS commenced legal proceedings against him for the balance sum of S$5,930,595. Lee Fook Kheun sought to defend the claim by making various allegations including that he was intoxicated and that he had not requested for credit. He also made a counterclaim for the partial payments he had paid earlier.

The trial of the matter was heard before the Honourable Justice Valerie Thean who found, amongst others, that Lee Fook Kheun had requested for the credit and was aware that he was requesting for the credit. Her Honour granted RWS’ claim in full while dismissing Lee Fook Kheun’s counterclaim.
